Loper Enterprises v. Raimondo: Curb the Administrative State

Advance Colorado Institute filed an amicus brief in this pivotal case challenging the Chevron Doctrine. This doctrine requires courts to turn a blind eye to federal agency decisions affecting business and has resulted in federal bureaucrats making law instead of Congress. This unaccountable federal rulemaking has damaged family-owned businesses and American industries for decades. Advance’s amicus brief argues that a constitutional separation of powers is required to hold government accountable and that the Chevron Doctrine should be overturned, with federal law-making authority held by Congress alone.
